INTER-RELIGION MARRIAGE VIA SPECIAL MARRIAGE ACT

Home INTER-RELIGION MARRIAGE VIA SPECIAL MARRIAGE ACT

Inter-religion marriages in India can be solemnized under the Special Marriage Act, 1954. This act is applicable to the entire country, including Faridabad, and allows individuals from different religions to marry each other without having to convert to the religion of their partner. Here are the general steps and practices involved in an inter-religion marriage under the Special Marriage Act in Faridabad:

1. Notice of Marriage:

  • Both parties need to give notice of their intention to marry at the office of the Marriage Officer in the district where either of the parties has resided for at least 30 days before the date of the notice.

2. Residential Proof:

  • Submit proof of residence in the form of a ration card or any other document as proof of residence.

3. Declaration:

  • Both parties need to declare that they are not related to each other within the prohibited degrees of relationships.

4. Witnesses:

  • The notice of marriage is then published by the Marriage Officer to invite objections, if any. After 30 days, if no objections are received, the marriage can proceed.

5. Objections:

  • If there are objections, the Marriage Officer will conduct an inquiry. If the objections are found to be invalid, the marriage can proceed.

6. Marriage Ceremony:

  • After the expiration of the notice period and the resolution of any objections, the marriage can be solemnized at the office of the Marriage Officer or any other place agreed upon.

7. Witnesses and Marriage Certificate:

  • The marriage ceremony should be conducted in the presence of three witnesses, and the Marriage Officer issues a marriage certificate.

8. Registration of Marriage:

  • The marriage should be registered within 60 days of the solemnization. The marriage certificate is then issued after registration.

9. Documents Required:

  • Proof of age (birth certificate, school leaving certificate, etc.).
  • Passport-sized photographs.
  • Residential proof.
  • Marriage affidavit.
  • Marriage invitation card (if available).

10. Marriage Registration Office:

  • The couple needs to visit the Marriage Registration Office in Faridabad to complete the formalities.

11. Marriage Certificate:

  • The Marriage Officer will issue the marriage certificate after the registration is complete.

12. Post-Marriage Procedures:

  • If the couple changes residence, they may need to update their address in the marriage registration office.

Important Points to Note:

  • It’s advisable to consult with a lawyer to understand the specific requirements and procedures in Faridabad.
  • Both parties should be of legal marriageable age (18 years for the bride and 21 years for the groom).
  • The Special Marriage Act provides for the solemnization of marriages without a religious ceremony.

Marriage procedures may evolve, and local practices may vary, so it’s essential to consult with local authorities or legal professionals for the most accurate and up-to-date information.
